Can You Travel With CBD?

This is such a great question and it’s extremely important to know if you plan on hopping on a jet plane! So to spare you the worry, we’ve outlined all of the laws regarding CBD and travel below, but to put it simply…

Domestic Travel – YES

International Travel – It depends, but it is probably best to err on the side of caution.

The first thing we should note is that we are talking about hemp derived CBD oil. CBD is found in both hemp and marijuana, but we are referring to CBD found in the hemp plant which only contains a small and legal percentage (0.3% or less) of tetrahydrocannabinol (THC).

The 2018 Farm Bill was a huge win for the hemp industry. The misunderstood hemp plant finally took its rightful place as a legitimate and fully legal agricultural crop. The signing of this bill removed hemp and hemp derivatives, such as CBD, from the Controlled Substance Act. This removes both CBD and THC (at levels 0.3% or less) from The Drug Enforcement Agency (DEA) Schedule V list.

“The  era  of  hemp  prohibition  is  over. Hemp  is now permanently  removed  from  the  Controlled Substances  Act (CSA). It  is  forever  deemed  an  agricultural  commodity,  no  longer mistaken  as a controlled substance, like marijuana.”

It took a few months for industries to catch up to this revolution, like the Transportation Security Administration (TSA), but they eventually implemented the necessary changes. And in May of 2019, the TSA announced their new policy surrounding CBD.

“Marijuana and certain cannabis infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA. (See the Agriculture Improvement Act of 2018, Pub. L. 115-334.)  TSA officers are required to report any suspected violations of law to local, state or federal authorities.” 

International travel is where things start to get really hazy. You will need to research the laws of the country you are visiting and the countries you will be passing through. Like we said before, it is best to err on the side of caution. Some countries have very strict drug laws, and we don’t want you stuck in jail overseas, do we?! 

Unless you are absolutely sure you won’t be thrown into a foreign jail, our suggestion for now is to leave your CBD home if you are planning to travel internationally. 

But feel free to bring all of your hemp derived CBD products on your carry-on or checked back for domestic flights!
